Canada’s Intellectual Property Firm

Steven Garland honoured by Benchmark Litigation as among the ‘Top 50 Trial Lawyers’ in Canada

Smart & Biggar is pleased to announce that Ottawa managing partner Steven Garland has again been named by Benchmark Litigation as one of the ‘Top 50 Trial Lawyers’ in Canada.

Benchmark Canada lauds Steven for being a leading member of the team, along with Toronto partners Mark Evans and Mark Biernacki, who successfully defended a trademark infringement action brought by Loblaws in relation to Pampered Chef’s use of its “PC” logo. The case wound its way to the Federal Court of Appeal, where Smart & Biggar triumphed in February 2021. Steven and fellow Ottawa partner Jeremy Want also scored at the Federal Court of Appeal when that court affirmed the Federal Court’s decision awarding Dow $650 million in a patent infringement matter brought against Nova Chemical, bringing this long-running matter to a close.

Steven has earned an outstanding reputation amongst colleagues and clients who view him as “the full package – he provides innovative legal strategy; he is unflappable in the courtroom and highly effective in cross-examination” (Lexology 2018 Client Choice) and “one of the most versatile trial lawyers in the Canadian IP community” (IAM Patents 1000, 2019).

The Top 50 Trial Lawyers’ are an elite group of individuals who have been nominated specifically for their acumen with bench trials and on the strength of peer and client reviews. Each practitioner chosen for has a list of proven achievements and has played a lead role in spearheading some of the most high-stakes and high-profile cases to make their way to the trial level in Canada.

Congratulations to Steven on receiving this prestigious title.
