Successfully invalidated the registration of a confusing trademark that was blocking the Applicant’s pending trademark application. The Applicant was successful on each ground of invalidity pled, as the Federal Court found not only that the registrant was not entitled to secure the registration in view of the Applicant’s prior use of its trademark, but also that the registrant had abandoned its registered trademark in Canada.
