Smart & Biggar represented the Plaintiffs, Groupe TVA and Videotron, which were largely successful at summary trial in the Federal Court (see 2022 FC 256). The Federal Court found that two of the three corporate defendants were jointly liable for copyright infringement committed by one and/or the other in the retransmission of TVA Sports (a French-speaking sports TV station) and prior to February 2021 for TVA (a very popular TV station in Québec) to hotels.
The Plaintiffs represented by Smart & Biggar appealed the finding that the third corporate defendant (Libéo) was not liable and were successful in having the Federal Court of Appeal overturned this conclusion from the summary trial.
