Nova Chemicals Corporation v The Dow Chemical Company et al

2020 FCA 141
Successfully represented The Dow Chemical Company (Dow) in the Federal Court of Appeal  (2020 FCA 141) which  affirmed the earlier decision (2017 FC 350 and 2017 FC 637)  where the Federal Court ordered Nova Chemicals Corporation (Nova) to pay Dow approximately $650 million as a result of Nova’s infringement of Dow’s patent on novel polyethylene blends.

This was the largest reported Canadian patent infringement award in history.
