Smart & Biggar again successfully represented Tekna Plasma Systems, the respondent in this appeal from a 2024 judgment that found most of the claims of the two patents asserted against Tekna to be invalid for ambiguity (and all non-infringed) (see Tekna Plasma Systems Inc v AP&C Advanced Powders & Coatings Inc, 2024 FC 871).
The patentee’s appeal was dismissed from the bench by the Federal Court of Appeal.
