We explore Canada-specific issues that brand owners should keep in mind when looking to protect their trademarks in Canada. For example, use is not required to obtain a Canadian registration and CIPO examiners can reject an application on the basis that the mark lacks distinctiveness. Brand owners should also be aware of Prohibited Marks in Canada.
